Terms of Service

Terms and conditions governing the use of the Energy Efficiency Center energy intelligence platform.

Effective from: September 12, 2025

Mexican Energy Sector Notice

These terms are specifically designed to comply with Mexican energy sector regulations, including requirements from PEMEX, SENER, CNH, and CRE. Use of this platform implies acknowledgment of the critical and regulated nature of national energy infrastructure.

1. Acceptance of Terms

By accessing and using the Energy Efficiency Center (EEC) platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, you should not use our services.

2. Description of Services

EEC provides AI-powered energy intelligence services including: PEMEX VIS system for volumetric anomaly detection, fuel efficiency analytics, fuel theft (huachicol) prevention, international energy legal consulting, and aggregated government transparency data access.

3. Service Tiers

We offer three service tiers: Public Tools (FREE) - Basic efficiency tool access. Professional Services ($1,000/year) - Intelligence reports and consulting. Enterprise Solutions ($10,000+/year) - Custom AI systems and real-time API access.

4. Acceptable Use

Users agree not to: Violate applicable Mexican energy sector laws or regulations, attempt unauthorized access to PEMEX or government systems, use the platform for illegal or fraudulent activities, interfere with platform security or integrity, or resell services without written authorization.

5. Intellectual Property

All content, AI algorithms, analysis methodologies, and platform technology are owned by EEC and protected by intellectual property laws. PEMEX and government data are used under applicable licenses and agreements.

6. Energy Sector Confidentiality

We recognize the sensitive nature of energy sector data. We maintain strict confidentiality of all operational information, comply with PEMEX security standards, and adhere to SENER, CNH, and CRE regulations.

7. Limitation of Liability

EEC shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed fees paid by you in the past 12 months. These limitations do not apply where prohibited by law.

8. Indemnification

You agree to indemnify and hold EEC harmless from any claims, damages, losses, liabilities, and expenses arising from your breach of these terms or misuse of the platform.

While our VIS system achieves 96%+ accuracy, users should independently verify critical information.

Regulatory Compliance

Users are responsible for ensuring compliance with all applicable energy regulations.

International Jurisdiction

International legal consulting services are subject to the laws of relevant jurisdictions.

9. Dispute Resolution

Any disputes related to these terms shall be resolved through binding arbitration in Mexico City, Mexico, under the rules of the Mexico Arbitration Center (CAM). The applicable law shall be Mexican federal law.

10. Termination

EEC may terminate or suspend your access immediately, without prior notice, for any breach of these terms, unauthorized use of PEMEX systems, or activities that endanger national energy security.

11. Updates to Terms

We reserve the right to modify these terms at any time. Changes will be effective upon posting. Your continued use of the platform constitutes acceptance of modified terms.
